Digital Trustees Berhad – Will Writing Services via Gambit Will Plan Platform
1. Introduction
These Terms of Use govern your access to and use of the Will Writing Services provided by Digital Trustees Berhad (“DTB”, “we”, “our” or “us”) through the Gambit Will Plan online platform hosted at gwp.digitaltrustees.com.my (“Platform”).
The Platform is provided, maintained or operated by Gambit Will Plan as a technology platform and digital service channel for DTB. DTB is the service provider of the Will Writing Services made available through the Platform.
By accessing the Platform, registering an account, submitting information, purchasing a package, making payment, or using the Will Writing Services, you (“Customer”, “you” or “your”) agree to be bound by these Terms of Use.
If you do not agree with these Terms of Use, you should not access, purchase or use the Will Writing Services through the Platform.
2. Role of Digital Trustees Berhad
DTB is responsible for the provision, processing, review, administration, preparation, coordination, storage, customer support, and fulfilment of the Will Writing Services, depending on the package selected by the Customer.
Unless expressly stated otherwise, all Will Writing Services purchased through the Platform are provided by DTB.
3. Role of Gambit Will Plan Platform
The Gambit Will Plan platform hosted at gwp.digitaltrustees.com.my is used as the digital platform for customer registration, package selection, information submission, payment processing, document workflow, customer communication, service administration, and related support.
Gambit Will Plan is to provide technology, hosting, system maintenance, customer support coordination, payment facilitation, workflow management, and other platform-related services to support the delivery of the Will Writing Services.
Unless expressly stated otherwise, Gambit Will Plan is not the trustee, will writing service provider, legal adviser, tax adviser, financial adviser, estate administrator, or probate adviser.
4. Scope of Services
DTB provides online Will Writing Services and related estate planning support services. Depending on the package selected, the services may include:
a. online will writing application;
b. collection of customer information;
c. preparation of will writing instructions;
d. drafting or preparation of a will document;
e. customer review and confirmation;
f. permitted amendments or revisions;
g. guidance on execution requirements;
h. secure record keeping or storage services, where applicable; and
i. other related support services offered from time to time.
The exact service scope shall depend on the package selected by the Customer at the point of purchase.
5. Standard and Customised Will Writing Services
Standard Will Writing Services currently range from RM700.00 to RM1,500.00, depending on the selected package, service scope, document complexity, promotional campaign, and any additional support services included.
Customised Will Writing Services may be charged differently from the standard package range. Customised services may be quoted separately based on the Customer’s requirements, estate structure, number of beneficiaries, special instructions, complexity of assets, additional consultation, trustee-related arrangements, or any other customised scope requested by the Customer.
The final applicable fee will be displayed or communicated to the Customer before payment is made.
6. Customer Eligibility
By using the Will Writing Services, you confirm that:
a. you are at least eighteen (18) years old;
b. you are of sound mind and are acting voluntarily without undue influence;
c. you have the legal capacity to make decisions regarding your estate planning;
d. the information provided by you is true, accurate, complete, and not misleading;
e. you are using the services for lawful purposes only; and
f. you understand that a will should reflect your true intention and must be executed properly in accordance with applicable legal requirements.
DTB reserves the right to reject, suspend, or cancel any application if there are reasonable concerns regarding legal capacity, fraud, incomplete information, conflict, suspicious activity, regulatory compliance, or operational risk.
7. Customer Responsibilities
You are responsible for:
a. providing complete and accurate personal information;
b. providing correct beneficiary, executor, guardian, asset, and instruction details;
c. reviewing all information before submission;
d. reviewing the will document or draft before confirmation;
e. ensuring that your instructions reflect your actual intention;
f. seeking independent legal, tax, financial, Shariah, or estate planning advice where required;
g. executing the will properly in accordance with applicable legal requirements; and
h. keeping your account login details secure.
DTB and Gambit Will Plan shall not be responsible for any error, omission, delay, invalidity, dispute, or loss arising from incorrect, incomplete, outdated, or misleading information provided by the Customer.
8. No Guarantee of Legal, Tax, Financial, or Probate Outcome
DTB may provide will writing support and related estate planning services, but we do not guarantee any specific legal, tax, financial, probate, inheritance, distribution, or estate administration outcome.
The effectiveness of a will is subject to various factors, including proper execution, witness requirements, the Customer’s legal capacity, family circumstances, asset ownership, nomination arrangements, applicable laws, future changes in law, and disputes by third parties.
Customers are encouraged to seek independent professional advice if they require legal, tax, financial, Shariah, cross-border, business succession, complex estate planning, or other specialised advice.
9. Online Platform Use
Customers must not misuse the Platform, website, application, system, or services. Prohibited activities include:
a. submitting false, fraudulent, or misleading information;
b. using another person’s identity without authorisation;
c. attempting to access another customer’s account;
d. interfering with the Platform’s operation or security;
e. uploading malicious files, viruses, or harmful code;
f. copying, modifying, or reverse engineering any part of the Platform;
g. using the Platform for unlawful purposes; or
h. breaching any applicable law or regulation.
DTB and/or Gambit Will Plan reserve the right to suspend or terminate access if misuse is suspected.
10. Account Registration and Security
Customers may be required to register an account to access certain features of the Platform or to use the Will Writing Services.
You are responsible for maintaining the confidentiality of your account login credentials, password, registered email address, mobile number, and device access.
You must notify DTB or the Platform support team immediately if you suspect unauthorised access, account misuse, password compromise, or any security breach.
DTB and Gambit Will Plan shall not be responsible for any loss arising from the Customer’s failure to secure their account, device, email account, mobile number, or login credentials.
Customers remain responsible for all activities carried out through their registered account unless they have notified DTB of unauthorised use.
11. Payment Terms
Full payment must be made before DTB commences the Will Writing Services, unless otherwise approved in writing by DTB.
Payment may be made through the available payment methods displayed on the Platform, which may include online banking, debit card, credit card, e-wallet, DuitNow, FPX, or other approved payment channels supported by the appointed payment gateway provider.
A payment is considered successful only when DTB, Gambit Will Plan, or the appointed payment gateway receives payment confirmation from the payment gateway, bank, or relevant payment channel.
DTB and Gambit Will Plan shall not be responsible for any delay caused by unsuccessful, pending, reversed, rejected, disputed, or incomplete payment transactions.
DTB is under no obligation to commence the Will Writing Services until cleared funds have been received.
12. Payment Gateway
Payments through the Platform may be processed by an appointed third-party payment gateway.
Customers may be subject to transaction approval, payment authentication, fraud screening, chargeback rules, settlement rules, and other requirements imposed by the relevant bank, card issuer, e-wallet provider, or payment gateway.
DTB and Gambit Will Plan do not store full card details, online banking credentials, or e-wallet login credentials. Payment information is processed by the relevant payment service provider according to its applicable security standards and terms.
13. Taxes
All service charges are subject to applicable taxes, duties, or government charges, including Sales and Service Tax (“SST”) where applicable.
If SST or any applicable tax is chargeable, the tax amount may be included in the package price or displayed separately before payment is made.
14. Service Commencement
The service is deemed to have commenced once any of the following has occurred:
a. the Customer has submitted personal information or will writing instructions;
b. DTB or its authorised support team has started reviewing the Customer’s information;
c. DTB has prepared, drafted, generated, or reviewed the Customer’s will document;
d. DTB has assigned the request to its service team, agent, drafter, or professional support personnel;
e. the Customer has accessed the online will writing module or downloaded any prepared document; or
f. DTB or the Platform support team has begun providing any consultation, support, review, or administrative service relating to the purchased package.
15. Refunds and Cancellations
Refunds and cancellations are governed by DTB’s Services Charges and Refund Policy, which should be read together with these Terms of Use.
16. Amendments and Revisions
Any amendment or revision to a will document shall depend on the package selected and the stage of service completion.
DTB may allow reasonable amendments before final confirmation or delivery, subject to the permitted package scope.
Additional charges may apply for major amendments, customised clauses, changes after document preparation, repeated changes, complex instructions, or requests outside the selected package scope.
17. Execution of Will
Customers are responsible for ensuring that the will is properly signed and witnessed in accordance with applicable legal requirements.
DTB may provide general execution guidance, but the Customer remains responsible for completing the execution process correctly. DTB provides general information only and is not responsible for supervising execution.
A will that is not properly signed, witnessed, or completed may be invalid or may be challenged.
18. Storage and Record Keeping
If the selected package includes document storage, digital record keeping, safe custody, or related services, such services shall be subject to the specific package terms, service period, storage method, access procedures, and applicable fees.
DTB may require identity verification before releasing or granting access to stored records or documents.
19. Customer Communications
Customers agree that DTB, Gambit Will Plan, or the authorised support team may communicate with them through email, SMS, WhatsApp, phone call, platform notification, or any other contact method provided by the Customer.
These communications may relate to account registration, payment status, document status, pending information, service updates, customer support, refund requests, security notices, or other service-related matters.
Any notice sent to the Customer's email, SMS, WhatsApp, phone call, platform notification or or any other contact method shall be deemed received by the Customer.
20. Intellectual Property
All content, templates, forms, documents, software, designs, text, graphics, logos, workflows, platform features, and materials made available through the Platform are owned by or licensed to DTB, Gambit Will Plan, or their respective licensors, unless otherwise stated.
Customers may use the materials only for their personal will writing and estate planning purposes.
Customers must not copy, reproduce, resell, distribute, modify, publish, or commercially exploit any materials, templates, platform features, or documents without prior written approval.
Except as expressly permitted, nothing in these Terms of Use transfers any intellectual property rights to the Customers.
21. Third-Party Services
The Platform may contain links, integrations, or references to third-party services, including payment gateways, identity verification providers, communication tools, hosting providers, or external websites.
DTB and Gambit Will Plan are not responsible for the content, security, availability, accuracy, practices, or terms of third-party services. Customers should review the relevant third-party terms before using such services.
22. Limitation of Liability
To the fullest extent permitted by law, DTB and Gambit Will Plan shall not be liable for any indirect, incidental, special, consequential, or punitive loss, including loss of profit, loss of opportunity, loss of data, business interruption, family dispute, probate delay, inheritance dispute, asset distribution dispute, or third-party claim arising from the use of the Platform or Will Writing Services.
23. Suspension or Termination
DTB and/or Gambit Will Plan may suspend, reject, or terminate the Customer’s access or service request if:
a. payment is unsuccessful, reversed, charged back, or suspected to be fraudulent;
b. the Customer breaches these Terms of Use and/or applicable laws;
c. false, misleading, or incomplete information is provided;
d. suspicious, unlawful, or abusive activity is detected;
e. DTB or Gambit Will Plan is required to do so for legal, regulatory, operational, security, or compliance reasons; or
f. the service request falls outside DTB’s service scope.
24. Personal Data Protection
DTB will collects, uses, stores, and processes your personal data in accordance with its Privacy Policy and the Personal Data Protection Act 2010 (“PDPA”).
Gambit Will Plan may process your personal data as technology platform provider, system operator, data processor, payment facilitation channel, support provider, or service support partner for DTB, where applicable.
By using the Platform or Will Writing Services, you consent to the collection, use, disclosure, and processing of your personal data as described in the Privacy Policy and the PDPA.
25. Changes to Terms
DTB may amend these Terms of Use from time to time to reflect changes in services, pricing, package structure, platform features, legal requirements, payment processes, or business operations.
The latest version of these Terms of Use shall be made available on the Platform or other official digital channel.
Continued use of the Platform or Will Writing Services after any update shall constitute acceptance of the revised Terms of Use.
26. Governing Law
These Terms of Use shall be governed by the laws of Malaysia.
Any dispute arising from or relating to these Terms of Use, the Platform, or the Will Writing Services shall be subject to the exclusive jurisdiction of the courts of Malaysia, unless otherwise agreed in writing.
27. Force Majeure
DTB shall not be liable for any delay or failure in performing the Will Writing Services where such delay or failure results from events beyond its reasonable control, including acts of God, natural disasters, epidemic, pandemic, governmental action, interruption of telecommunications, internet failure, cyber incidents, labour disputes or failures of third-party service providers.28.
